Every reference to “Applix”, “APPLIX”, “www.applix.co.za”, “www.Applix.co.za”, “Applix.co.za”, “us”, “we”, ”seller”, “the Website”, “the Company” and “our” in these terms and conditions refer to Applix Distributors, Close Corporation number: 2009/100175/23. Any references to “your”, “you”, “user” or “You” refer to any user and/or visitor of www.applix.co.za (“Website” or “website”). If you visit or shop at Applix, or if you create hyperlinks to www.applix.co.za, you accept and agree to comply with the most recent version of this agreement in its entirety.

Acceptance of terms:

Applix permits the use of this website subject to the Terms and Conditions (“Terms and Conditions”). By using this website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally.

Applix reserve the right to amend this agreement or any parts thereof at any time and without notice and you are accordingly encouraged to check the Website regularly. If there is a direct correlation towards the product and new agreement, the agreement will apply as soon as it is published onto the website. When placing an order, the agreement in force at the time of your placing the order will apply to that order and its related transactions.

No hidden fees or purchasing obligations:

We at Applix are transparent with all prices and thus there are no fees for registering or having an account with us. You are entitled to purchase when and whichever item you want with no obligations throughout the process of purchasing.

Use of site:

You may only use this site to browse the content, make legitimate purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase.

This site and the content provided in this site may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed. Deep-linking, embedding or using analogous technology is strictly prohibited. Unauthorized use of this site and/or the materials contained on this site may violate applicable copyright, trademark or other intellectual property laws or other laws. You agree not to interfere or attempt to interfere with the website using a device or software. In addition, you agree that you will not use any robot, spider, other automatic device, or manual process to monitor, copy, distribute or modify the Website or the information contained herein, without the prior written consent from an authorised Applix representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this Website).

You may not use the Website to distribute material which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.

You may not display, publish, copy, print, post or otherwise use the Website and/or the information contained therein for the benefit of any other website without the express prior written consent of an authorised Applix representative.

Our rights:

– Modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

– Change these Terms and Conditions from time to time, and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed. Should you not be satisfied with the amendments, you are invited to contact the Applix support team (support@applix.co.za) or must refrain from placing any further orders on, or from using in any way, the Website.

– We will use our most reasonable endeavours to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website due to circumstances beyond our control.

– Ownership of all goods supplied remains vested in Applix until payment is made in full.

Delivery Policy:

Unless otherwise specified, delivery on all orders is free of charge anywhere in South Africa. The delivery of our products is subject to stock availability with our suppliers. Requests for products and pricing will be immediately processed and it will be ready for dispatch in accordance to the product. Please note that goods will only be delivered once payment has been received in full.

Applix is not responsible for delays in deliveries due to the importation of goods, unless we have notified you personally. This includes, but not limited to:

  • Shipping delays from overseas suppliers
  • Shipments detained by customs
  • Acts of God
  • Inspections from SARS
  • Port dealth inspections
  • Flight delays

Should an order be delayed due to any of the reasons above, the customer will not be entitled to a refund. Applix will supply all products via our own delivery services, or via an authorized and trusted courier partner. We will ensure that the product arrives at the requested delivery address in good order.

Receiving Goods

If a delivery is made and the recipient is not available to collect at the address specified, or the telephone number supplied, the shipment might be returned to Applix and you will be liable for any shipping costs that arise due to non-delivery.

Should a product be returned to us as undeliverable, we will contact you immediately via the contact details you have provided, and will request that arrangements be made to re-deliver the product to you. You may also choose to collect your shipment. You authorize us to dispose, in a manner that we see fit, of the contents of all orders not collected within 30 days of such request being made.

You accept that in order for us to confirm that an order, or part of an order, was delivered, we do not necessarily have to prove that you have personally received the goods, but rather that a person at the delivery address you specified signed for the delivery. Please ensure that there is someone at your specified address to receive the products. Please note that we do not deliver to P.O. boxes; please supply your residential or work address.  If you choose to collect your order, please contact us in advance so that we can ensure your product is in stock and ready for collection.

Order Confirmation

After placing an order with Applix, you will receive an email notification to confirm our receipt of your order request.

When you choose to purchase from Applix, legal obligations arise and your right to have monies refunded to your credit card, or any other way agreed by us, is limited by our terms and conditions. You must not purchase through Applix unless you understand and agree to all of our terms and conditions.

Once payment is received, it is assumed that you have read and understood the terms and conditions for such purchase. Once payment has been made, you may cancel your order under certain conditions (see returns, refunds and cancellations sections below for further details).

Shipping Confirmation

Once your order is shipped, you will receive a second e-mail message confirming your shipment details, including tracking information. This is to ensure that you are completely informed at all times with regards to the order process.

Delivery Times

All product orders will have different delivery times, according to stock availability, and the physical delivery address that was provided.

You will be provided with an estimated delivery time immediately, once the order has been placed and payment has been confirmed. Estimates of delivery times for specific products will be clearly placed on the product description section on the particular product page, or confirmed via e-mail to you by Applix.

Delivery times are dependent on suppliers’ stock availability, and estimated times given by suppliers for certain products, while other product orders will depend on the stock on hand.

Important To Note:

  • Goods will only be delivered once payment has been received in full.
  • Delivery times are only regarded as having commenced upon payment confirmation being received by Applix.
  • If products with different delivery times are ordered together, the product with the longest delivery time will determine the delivery time of all the products in the order. Should you require a faster delivery time, we recommend that you order products separately.

Returns and Refunds Policy:

At Applix we strive to step into the shoes of our customers in order to help them understand the online buying process and to eliminate any negative feelings or fears. We respect our customers and we truly want them to always be completely satisfied with the Applix experience.

If a return is required as a result of damage, defects, or a mistake made by us, we will be responsible for the delivery charges – both to have your item sent back to us, and to send you a replacement item. Applix allows for returns in accordance with the provisions of section 20(2)(a) to (d) of the Consumer Protection Act 68 of 2008.

We can only accept items that are returned to us without signs of wear and tear or abuse, and with all of the original contents and packaging intact within 24 hours of delivery. The following applies:

–          “Wear and tear” refers to any damage that was not present when the merchandise was received, such as rack mounting damage, scratches, dents, etc.

–          “Contents” consists of any included parts and accessories, as well as the warranty card and manual, without any user notes or markings.

–          “Packaging” includes all inner and outer packaging, complete with the original barcode affixed.

All returned items must be in a brand new condition, unused, and include any related original tags and packaging. Requests to return items due to quality issues, damage during shipping, colour/style/size errors or allergic reaction from use, must be accompanied by clear photos or other evidence that clearly shows the problem associated with the item received. Evidence can be sent via email to Applix with the original invoice (orders@applix.co.za) or faxed (011 706 7140).

If you have used a product and found it to be damaged or faulty we will collect the product at our expense and either replace, refund or repair the item, depending on the circumstances and legitimate proof provided.

If any damage is apparent or products are not the same as requested order on delivery, this fact must be reported to Applix within 24 hours of the product been delivered. Once the product is approved for return by us, we will notify you to arrange the best time suitable for you, for product collection. A replacement/ refund will then be arranged as per your convenience.

We reserve the right to charge a reasonable handling fee on all items returned for other reasons not specified or approved by Applix.

You will receive a return authorization number via email or SMS (to the contact details provided), instructions for sending your product back, and an address for the return. Once our warehouse receives the returned merchandise, a refund is typically processed within 2-4 business days (Monday through Friday).

When your return has been processed, we will send a confirmation to the email address you have provided us on our database with your original order.

Policy Exceptions

  • Copyrighted materials cannot be returned once opened due to copyright law. This includes books, videotapes, DVD’s, sample libraries, style, disks, sound expansion boards and software (which may also include software bundled with hardware).
  • Blank media cannot be returned once opened due to the possibility they have been used. This includes cassettes, open reel tape, ADAT, DAT, CD, DVD, Blu-Ray Disks, MiniDisc, removable memory cards and hard drives.
  • Disposable products cannot be returned once opened. This includes cleaning supplies, are products and rosin.
  • All instrument parts cannot be returned once opened due to the possibility that they have been used. This includes all guitar, amplifiers and turntable parts.
  • Please confirm that hardware is compatible with your operating system and any existing hardware prior to purchase as we cannot accept hardware returns as a result of system incompatibility.
  • Gift certificates and discount coupons cannot be returned.
  • Due to certain applicable legislation or for reasons of cost efficiency; the goods we exclude from the return and exchange policy are goods which have been ordered through special arrangement or custom order and which is not a normal stock item may only be returned if defective. This, however, in no way affects the warranty or repairs services for that product.

Returning packages without prior approval from a member of Applix will halt or delay your return. Not all returns and cancellation requests will be granted due to the nature of a particular product and acquiring that specific product.

Our return policy is very generous, but these exceptions are necessary; please consider them in making your purchase. If there are any questions as to whether an item is included in the list of exceptions before you buy, please contact us (support@applix.co.za).

Being honest about the reason of a return will simply help us process your exchange, replacement, or refund more efficiently. We will always respond to your request as swiftly and understanding as possible.

Cancellations Policy

In accordance with Section 44 of the Electronic Communications and Transactions Act 25 of 2002 (ECT Act) you are entitled to cancel your purchase within seven (7) calendar days, after date of receipt of the products purchased and obtain a full refund (in accordance with our Returns and Refunds policy and excluding the courier delivery fee), within 30 calendar days thereafter.

Should you for any reason wish to cancel your purchase; you will be liable for all shipping costs that may arise, caused by the shipping of the requested item back to the original seller. All return requests must be made within 48 hours from delivery. For orders cancelled beyond 48 hours but within 7 days, a 50% restocking fee on the purchase will apply.

You must advise us via email (orders@applix.co.za) or phone (011 706 7081) of your cancellation and any such cancellation must be signed or sent directly by the person who made the original purchase. Note that refunds are subject to the supplier authorising the return, which is confirmed via Applix for each order placed with us.

  • If we shipped you the wrong item: You have the option of either exchanging it for the correct item. Customers must confirm their eligibility for an exchange or return with Applix Customer Service (support@applix.co.za) before sending items back.
  • If we shipped you an item in the wrong colour, you have the option of either exchanging it for the correct colour. (Perceived colour differences due to the display settings of your computer monitor are not grounds for a refund).
  • If we shipped you a defective item: You are eligible for a refund or exchange depending on the proof provided of such defect.
  • If a product purchased is not delivered or is anticipated to be delivered at a later stage than within the agreed delivery period: Applix will notify you immediately or a full refund will be available to you on the purchase price of the item if you wish to cancel your order.
  • What orders may not be cancelled: All special arrangement/customer orders cannot be cancelled once placed and confirmed by Applix.

Stock Availability

Stock on all our goods are limited and Applix shall take all reasonable efforts to ensure that when stock is no longer available, it will be restored or that offers thereof are discontinued.

However, should Applix be unable to fulfil any order placed by you at the advertised price due to stock having sold out, Applix will notify you immediately and you will be entitled to a refund of the amount paid by you.

Security policy:

Virtual Card Services process all credit card transactions. All credit card transactions utilize 256-bit Secure Socket Layers (SSL) encryption via our payment gateway provided. The company registration documents and the site registered domain name are checked and verified by SSL, ensuring the cardholder and merchant that nobody can impersonate VCS to obtain confidential information.

Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Virtual Card Services Internet servers are protected by firewalls and intrusion detection systems.

The Merchant does not have access to credit details.

Virtual Card Services continually reviews and enhances its security in line with technological changes.

Any person that delivers or attempts to deliver any damaging code to this website or attempts to gain unauthorised access to any page on this Website shall be prosecuted and civil damages shall be claimed in the event that Applix suffers any damage or loss.

You agree and warrant that your log-in name and password shall:

  • be used for your personal use only; and
  • not be disclosed to any third party.

You allow Applix to take all reasonable steps to ensure the integrity and security of the Applix website and back-office applications.

All credit card transactions are Secure Socket Layers encrypted. Applix’s registration documents and the website’s registered domain name are checked and verified by the SSL provider.

Monitoring:

We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Terms & Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website).

Governing Law:

The Terms and Conditions will be exclusively governed by and construed in accordance with the laws of the Republic of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions.

 

Electronic communications:

When you visit applix.co.za or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Terms and Termination:

These terms and conditions shall start from the date on which they are published on the Website and continue indefinitely, as amended by Applix from time to time (as described above), for so long as the Website exists and is operational, Applix being entitled to terminate these terms and conditions and/or shut down the Website at any time (subject to still processing any orders then already placed and accepted by Applix). Terms of section 44(2) of the Electronic Communications and Transactions Act 25 of 2002, you will be liable for direct costs of returning a product.

Pricing:

Agreement of Sale:

This Agreement of Sale governs the sale of products (“Goods”) by the Company to you via the Website.

An order will be placed with us once you have selected to the add cart button. Placing a product in your online “cart” or “trolley” does not constitute an order for that product and we cannot be held liable if the product is no longer available, or if the price has changed by the time the checkout process is completed. This acceptance will be deemed as written consent (as set out in section 12 of the ECT Act) to have information relating your location to be made available to Applix.co.za.

Coupons:

  • Applix only allows the usage of one coupon during checkout.
  • Each unique coupon may only be redeemed once per customer. The following specific terms and conditions apply to the use of a coupon:
  • A coupon can only be used with promotional offers on the Website.
  • Only one Coupon can be used per shopping basket.

Consumers may not be entitled to any rights, including any rights for repair or replacement against licensed dealers of the product or the manufacturer. Severability:

By placing an order for a Product that requires you to be in possession of a valid television licence, you shall be deemed to have consented to us obtaining your personal information from the SABC for the purposes of verifying whether you are in possession of a valid licence.
